TERMS & CONDITIONS

These Terms & Conditions (“Terms”) are a legally binding agreement between you (“Customer,” “you,” or “your”) and SUP Rents LLC, doing business as SUPrents (“SUPrents,” “we,” “us,” or “our”).
By purchasing, ordering, receiving, possessing, participating in a 7-Day Demo of, or using a Onewheel or other product obtained through SUPrents, you acknowledge that you have read, understood, and agree to these Terms.
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE IMPORTANT PROVISIONS CONCERNING ASSUMPTION OF RISK, RELEASE OF LIABILITY, LIMITATION OF LIABILITY, AND RESPONSIBILITY FOR DAMAGE.
1. ONEWHEEL SALES
SUPrents is an authorized Onewheel dealer.
Products may be sold as new, open-box, or used. The condition, warranty coverage, eligibility for the SUPrents 7-Day Demo, and return eligibility vary depending on the type of product purchased.
Prices and availability are subject to change without notice. An order confirmation does not necessarily constitute acceptance of an order. SUPrents reserves the right to cancel or refuse an order before shipment, including because of inventory errors, pricing errors, suspected fraud, payment issues, or other circumstances reasonably requiring cancellation.
If SUPrents cancels a paid order before shipment, the amount paid for the canceled item will be refunded.
2. NEW ONEWHEELS
Onewheels sold by SUPrents as new are brand-new products and include the applicable manufacturer warranty.
Unless otherwise stated on the product page, new Onewheels purchased through SUPrents are eligible for the SUPrents 7-Day Demo described below.
Manufacturer warranties are provided by the manufacturer and are subject to the manufacturer's applicable warranty terms, limitations, exclusions, and procedures.
SUPrents does not make any additional manufacturer warranty or extend the manufacturer's warranty unless expressly stated in writing.
3. OPEN-BOX ONEWHEELS
Onewheels identified as open-box are like-new Onewheels with less than one mile unless otherwise disclosed in the individual product listing.
Open-box Onewheels include the full applicable manufacturer warranty.
OPEN-BOX ONEWHEELS ARE FINAL SALE AND ARE NOT ELIGIBLE FOR THE SUPrents 7-DAY DEMO.
Customers should review the applicable product listing before purchasing.
4. USED ONEWHEELS
Onewheels identified as used have been previously ridden. Mileage and condition vary and are disclosed on the applicable product listing to the best of SUPrents' knowledge.
Used Onewheels are inspected and tested before being listed for sale.
USED ONEWHEELS ARE FINAL SALE AND DO NOT INCLUDE A MANUFACTURER WARRANTY UNLESS EXPRESSLY STATED OTHERWISE IN WRITING.
Normal cosmetic wear consistent with the disclosed mileage and condition is not considered a defect.
5. SUPrents 7-DAY DEMO
The SUPrents 7-Day Demo applies only to eligible new Onewheels.
The seven-day period begins on the day the Onewheel is delivered to the Customer.
If the Customer decides to keep the Onewheel, no further action is required.
If the Customer decides to return the Onewheel, the Customer must contact SUPrents to request a prepaid return shipping label and must deliver the packaged Onewheel to UPS no later than 5:00 PM on the seventh day following delivery.
SUPrents pays the standard return shipping charge using the prepaid return label supplied by SUPrents.
If the Onewheel is returned under the 7-Day Demo, the applicable demo fee will be retained from the Customer's payment. Other applicable charges—including late fees, damage charges, missing-item charges, accessory charges, or other amounts permitted under these Terms—may also be deducted from the Customer's refund.
Current demo fees are disclosed on the SUPrents 7-Day Demo page and/or applicable product page at the time of purchase.
The terms and fee applicable when the Customer places the order govern that Customer's transaction.
6. LATE 7-DAY DEMO RETURNS
A returned demo Onewheel must be delivered to UPS by the required return deadline.
Unless otherwise expressly agreed to by SUPrents in writing, late demo returns are subject to a $60-per-day late fee.
By participating in the 7-Day Demo, the Customer authorizes SUPrents, to the extent permitted by law and the Customer's payment agreement, to deduct applicable late fees from amounts otherwise refundable or to charge amounts legitimately owed under these Terms using the payment method associated with the transaction.
Failure to return a demo Onewheel does not transfer ownership to the Customer except as expressly provided by the terms of the original purchase transaction.
7. CONDITION OF RETURNED DEMO ONEWHEELS
Customers may ride an eligible Onewheel during the 7-Day Demo under normal riding conditions.
The Customer is responsible for loss, theft, missing components, abuse, misuse, unauthorized modification, and damage beyond any protection expressly provided by purchased 7-Day Demo Damage Protection.
If a returned Onewheel has damage not covered by applicable Damage Protection, SUPrents may deduct the reasonable cost of inspection, repair, replacement parts, labor, associated shipping, or replacement of the Onewheel from the Customer's refund to the extent permitted by law and these Terms.
SUPrents may document the condition of a returned Onewheel through photographs, video, diagnostic information, mileage, service records, or other reasonable means.
8. 7-DAY DEMO DAMAGE PROTECTION
Customers participating in the 7-Day Demo may be offered optional Damage Protection.
Damage Protection is not insurance and is not a warranty.
Coverage is limited to the specific protection described on the SUPrents 7-Day Demo Damage Protection page in effect when the Customer places the order.
Damage Protection generally applies to accidental riding damage and ordinary cosmetic riding wear occurring during normal use within the 7-Day Demo period, subject to the exclusions stated in the Damage Protection terms.
Damage Protection does not cover theft, loss, intentional damage, reckless or abusive use, misuse, missing components, water damage, sand damage, use outside the Demo period, or other excluded circumstances described in the applicable Damage Protection terms.
9. ACCESSORIES
Accessories purchased with a new Onewheel may be subject to different return terms from the Onewheel itself.
When an eligible Onewheel is returned through the 7-Day Demo, eligible accessories returned with it may receive a refund of 50% of the accessory purchase price, subject to the applicable terms in effect when the order was placed.
Accessories that are damaged, missing, modified, or otherwise ineligible may receive no refund.
10. SHIPPING AND DELIVERY
SUPrents currently provides free standard Onewheel shipping within the lower 48 United States unless otherwise stated.
Estimated shipping and delivery dates are estimates and are not guarantees.
Once a shipment has been transferred to the carrier, circumstances outside SUPrents' reasonable control—including carrier delays, weather, natural disasters, transportation disruptions, incorrect delivery information, theft after confirmed delivery, and other events—may affect delivery.
Customers are responsible for providing a complete and accurate shipping address and for promptly reviewing tracking information.
11. SALES TAX
SUPrents does not collect sales tax on orders shipped outside Washington State.
Customers may have tax obligations in their state or other jurisdiction. The Customer is responsible for determining and satisfying any tax obligation imposed on the Customer that SUPrents is not legally required to collect.
12. ONEWHEEL RIDING INVOLVES SERIOUS RISK
WARNING: RIDING A ONEWHEEL IS AN INHERENTLY DANGEROUS RECREATIONAL ACTIVITY THAT CAN RESULT IN FALLS, COLLISIONS, LOSS OF CONTROL, SERIOUS BODILY INJURY, PERMANENT DISABILITY, PROPERTY DAMAGE, OR DEATH.
Risks may arise from, among other things, rider error; loss of balance; speed; terrain; pavement conditions; trails; hills; obstacles; vehicles; pedestrians; animals; weather; reduced visibility; equipment behavior; battery or electrical conditions; improper use; failure to follow warnings or instructions; and the acts or omissions of the rider or third parties.
No Onewheel can eliminate these risks.
BY CHOOSING TO RIDE OR PERMIT THE USE OF A ONEWHEEL OBTAINED FROM SUPRENTS, YOU KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH ONEWHEEL RIDING, INCLUDING THE RISK OF SERIOUS INJURY OR DEATH.
13. RIDER RESPONSIBILITY
The Customer is responsible for learning how to safely operate the Onewheel and for reviewing and following all manufacturer instructions, warnings, safety information, and applicable laws.
The Customer is responsible for determining whether the rider has the experience, physical ability, judgment, and appropriate conditions necessary to ride safely.
SUPrents strongly recommends wearing appropriate safety equipment, including a properly fitted helmet, whenever riding.
The Customer must not use or permit use of a Onewheel while impaired by alcohol, drugs, medication, fatigue, or any other condition that could impair safe operation.
The Customer is responsible for complying with applicable laws, regulations, trail rules, roadway rules, and restrictions concerning where and how a Onewheel may be operated.
14. RELEASE AND WAIVER OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE CUSTOMER KNOWINGLY AND VOLUNTARILY RELEASES AND DISCHARGES SUP RENTS LLC, DBA SUPRENTS, AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM CLAIMS ARISING FROM OR RELATING TO THE CUSTOMER'S PARTICIPATION IN ONEWHEEL RIDING OR USE OF A ONEWHEEL OBTAINED THROUGH SUPRENTS, INCLUDING CLAIMS ARISING FROM RISKS INHERENT IN THE ACTIVITY AND, TO THE EXTENT LAWFULLY WAIVABLE, CLAIMS ARISING FROM ORDINARY NEGLIGENCE.
THIS RELEASE IS INTENDED TO BE AS BROAD AS PERMITTED BY APPLICABLE LAW. IT DOES NOT RELEASE LIABILITY THAT CANNOT LAWFULLY BE RELEASED OR WAIVED.
Nothing in these Terms is intended to waive rights or remedies that applicable law prohibits the Customer from waiving.
15. PRODUCT MANUFACTURER
Onewheel products are manufactured by Future Motion, Inc., not SUPrents.
SUPrents is a retailer and authorized dealer and does not design or manufacture Onewheel products.
Nothing in these Terms is intended to misrepresent or alter any rights or obligations that cannot legally be limited concerning an alleged manufacturing, design, warning, or other product defect.
16. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPRENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM A TRANSACTION WITH SUPRENTS OR THE USE, POSSESSION, STORAGE, TRANSPORTATION, OR OPERATION OF A PRODUCT PURCHASED OR OBTAINED FROM SUPRENTS, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Where applicable law does not permit a particular exclusion or limitation, that exclusion or limitation shall apply only to the maximum extent permitted by law.
17. INDEMNIFICATION
To the extent permitted by applicable law, the Customer agrees to indemnify and hold harmless SUP Rents LLC, dba SUPrents, and its owners, members, managers, employees, agents, representatives, successors, and assigns from third-party claims, damages, liabilities, losses, and reasonable costs arising from the Customer's misuse of a product, violation of law, unauthorized modification of a product, breach of these Terms, or use of the product by a person to whom the Customer provides or entrusts it.
This provision does not require the Customer to indemnify SUPrents for liability that cannot lawfully be shifted to the Customer.
18. UNAUTHORIZED MODIFICATION AND MISUSE
SUPrents is not responsible for consequences arising from modifications, alterations, repairs, accessories, software changes, firmware changes, or other changes made after the product leaves SUPrents' possession when those changes are not performed or authorized by SUPrents.
Customers are responsible for ensuring that modifications and accessories are compatible with their Onewheel and comply with applicable manufacturer instructions and law.
19. MINORS
Onewheels should only be operated in accordance with applicable manufacturer age recommendations, warnings, and applicable law.
A parent or legal guardian who purchases or provides a Onewheel for use by a minor is responsible for supervising the minor, determining whether use is appropriate, ensuring appropriate safety equipment is used, and ensuring compliance with manufacturer instructions and applicable law.
Nothing in these Terms purports to waive a minor's rights where such a waiver is prohibited by applicable law.
20. ELECTRONIC AGREEMENT
The Customer agrees that electronic acceptance of these Terms has the same effect as acceptance in writing to the extent permitted by applicable law.
Electronic records and contracts are recognized under Oregon law. Oregon Legislature
SUPrents may retain electronic records showing the version of these Terms accepted by the Customer, the date and time of acceptance, transaction information, and other information reasonably necessary to document the agreement.
21. GOVERNING LAW
To the extent permitted by applicable law, these Terms and disputes between the Customer and SUP Rents LLC shall be governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
Nothing in this section deprives a consumer of protections that applicable law does not permit the parties to waive.
22. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and, where appropriate, severed from the remaining Terms.
The remaining provisions shall remain in effect to the fullest extent permitted by law.
23. NO WAIVER
A failure by SUPrents to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or SUPrents' right to enforce it later.
24. CHANGES TO THESE TERMS
SUPrents may revise these Terms from time to time.
Changes apply prospectively. The terms applicable to a purchase or 7-Day Demo are the terms presented or otherwise applicable when the Customer enters into that transaction, except where the parties subsequently agree otherwise or applicable law requires otherwise.
25 . SMS MARKETING
By opting in to receive SMS marketing from SUPrents, you agree to receive recurring marketing text messages from SUPrents at the mobile number you provide. Messages may include product updates, open-box availability, promotions, special offers, and other SUPrents news.
Consent to receive marketing text messages is not a condition of purchasing any product or service. Message frequency may vary. Message and data rates may apply.
